Notice and Takedown Procedure
itslearning respects the intellectual property rights of others and asks its users to do the same. This policy explains how to raise a concern about content in the itslearning platform and how such content is removed.

About this process
itslearning is a learning platform used by schools, local authorities, colleges and other education organisations. itslearning environments are closed sites provided to a specific customer, for example a school or school owner, and its authorised users. They are not public and are not accessible to anyone outside that customer. The customer owns and controls the content in its environment, and itslearning does not monitor it.
How to raise a concern
If you believe content in an itslearning environment infringes your rights, notify the relevant customer, the school or institution that controls the environment. They are the party able to view, assess and act on the content, and they will notify itslearning where content needs to be removed. If you cannot identify or reach the relevant customer, or the matter is urgent, you may contact itslearning directly. We will act where appropriate.
What a valid notice must contain
Whether you notify the customer or itslearning, the notice should come from the copyright owner, an exclusive licensee, a publisher or rights holder, or a representative authorised to act for the owner, and should include:

who you are, and your authority to act if you are not the owner of the copyrighted work

the specific material in itslearning and where it appears, or enough detail to locate it without a broad search across the platform

why you believe the use is unauthorised

your contact details (stating, as a minimum, your name or company name and a contact email address)
- a good-faith statement that the use is not authorised and that the information is accurate
We cannot act on general or speculative notices, for example that the platform contains your materials, without enough detail to identify the specific item.
What happens next
The customer or itslearning, as applicable, investigates the notice, identifies the relevant user, assesses the claim, and decides whether the content should be removed. itslearning does not monitor or assess customer content.
Where the customer decides that content should be removed, it instructs itslearning if applicable, and itslearning removes or disables access to the content on that instruction.
Where itslearning is contacted directly, it acknowledges receipt, checks that the notice is complete and specific enough to locate the material.
itslearning will remove or disable access on the customer’s instruction, on a valid legal notice, or, at its discretion and in good faith, and will notify the customer and the copyright holder without undue delay, except where the law or a competent authority requires otherwise.
Limits of this process
We do not monitor all content, do not search the platform for a rights holder's materials, and do not determine whether content infringes or decide questions of ownership. The customer owns and controls the content and is the party that investigates a concern and decides whether to remove it.
Where we act, we do so at our own discretion and would address only the specific item identified. Otherwise the matter is for the customer, or for the parties to resolve directly or through a competent authority.
Privacy
We process the information in a notice to review, handle and record the complaint, and handle personal data in line with applicable data protection law.
